Dark Dance Camp Winter 2027
§ 1. Organizator
1.1. Organizatorem wydarzenia i sprzedawcą biletów jest Magnitudo Group sp. z o.o. z siedzibą we Wrocławiu, ul. Wyspa Słodowa 7 lok. 220, 50-266 Wrocław, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego pod numerem KRS 0001067988, NIP 8971929665, REGON 526938578 (dalej: Organizator).
1.2. Adres do kontaktu we wszystkich sprawach dotyczących biletów, uczestnictwa i danych osobowych: office@darkdancestudio.com.
1.3. Niniejszy Regulamin określa zasady sprzedaży wstępu na wydarzenie oraz zasady uczestnictwa w nim. Zakup biletu oznacza akceptację Regulaminu.

§ 2. Wydarzenie i przedmiot sprzedaży
2.1. Dark Dance Camp Winter 2027 (dalej: Wydarzenie) jest imprezą o charakterze kulturalno-rozrywkowym, odbywającą się w dniach 19–21 lutego 2027 r. pod adresem Grabiszyńska 241d, 53-235 Wrocław.
2.2. Przedmiotem sprzedaży jest prawo wstępu na Wydarzenie w miejscu i terminach wskazanych w pkt 2.1. Przedmiotem sprzedaży nie jest kurs, cykl zajęć, abonament ani dostęp świadczony online lub w inny sposób na odległość.
2.3. Wydarzenie odbywa się stacjonarnie przez trzy dni i obejmuje:
a) zajęcia prowadzone przez zaproszonych instruktorów, zgodnie z opublikowanym harmonogramem;
b) nagrania, w tym selects, podczas których instruktor tańczy z wybranym uczestnikiem albo uczestnik występuje indywidualnie, rejestrowane przez operatora kamery;
c) pozostałe punkty ogłoszone w harmonogramie, w tym imprezy, jamy i spotkania związane z Wydarzeniem.
2.4. Wszystko, o czym mowa w pkt 2.3, odbywa się osobiście, w miejscu Wydarzenia, w godzinach wskazanych w harmonogramie. Organizator nie zapewnia transmisji, uczestnictwa zdalnego, nagrań do późniejszego wykorzystania ani żadnych materiałów do zabrania.
2.5. Wstęp uprawnia Uczestnika do obecności na Wydarzeniu w czasie jego trwania. Nie uprawnia do otrzymania nagrania zajęć, kopii materiału filmowego ani jakichkolwiek innych materiałów.
2.6. Wstęp nie obejmuje transportu, zakwaterowania, wyżywienia, ubezpieczenia ani sprzętu.

§ 3. Rodzaje wstępu
3.1. Sprzedawane są trzy rodzaje wstępu. Każdy z nich stanowi wstęp na Wydarzenie w miejscu i terminach wskazanych w pkt 2.1 i różni się wyłącznie zakresem Wydarzenia, który obejmuje:

3.2. Każdy rodzaj wstępu sprzedawany jest w ograniczonej liczbie. Po wyczerpaniu limitu sprzedaż danego rodzaju zostaje zakończona.
3.3. Harmonogram jest ustalany przed Wydarzeniem i może ulec zmianie w jego trakcie. O jego składzie, kolejności i godzinach decyduje Organizator.

§ 4. Cena, podatek i faktury
4.1. Wszystkie podane ceny są cenami brutto i zawierają polski podatek od towarów i usług. Zastosowana stawka oraz kwota netto są wyszczególnione na fakturze.
4.2. Usługi wstępu na imprezy kulturalne i rozrywkowe podlegają opodatkowaniu w miejscu, w którym impreza faktycznie się odbywa. W związku z tym każdy bilet objęty jest polskim podatkiem VAT, niezależnie od miejsca zamieszkania Uczestnika i miejsca dokonania płatności. Powyższe wynika z art. 28g ust. 1 ustawy z dnia 11 marca 2004 r. o podatku od towarów i usług oraz art. 53 dyrektywy Rady 2006/112/WE.
4.3. Zasada określona w pkt 4.2 znajduje zastosowanie również do zakupów dokonywanych przez przedsiębiorców. Mechanizm odwrotnego obciążenia nie ma zastosowania do usług wstępu. Organizator nalicza i rozlicza polski podatek VAT także wtedy, gdy nabywca posiada numer identyfikacyjny VAT nadany w innym państwie członkowskim Unii Europejskiej.
4.4. Nabywca, który chce otrzymać fakturę wystawioną na przedsiębiorcę, podaje w toku zakupu numer VAT UE tego przedsiębiorcy. Organizator weryfikuje numer w systemie VIES w chwili sprzedaży i zachowuje datowany zapis tej weryfikacji.
4.5. Każdy zakup skutkuje wystawieniem przez Organizatora faktury, wskazującej Wydarzenie, miejsce i terminy. Faktura jest wysyłana na adres poczty elektronicznej podany w toku zakupu.

§ 5. Zakup
5.1. Bilety sprzedawane są wyłącznie online, za pośrednictwem strony sprzedaży Wydarzenia.
5.2. Płatności obsługuje Stripe Payments Europe, Ltd. Organizator nie otrzymuje, nie przetwarza ani nie przechowuje danych kart płatniczych.
5.3. Umowa zostaje zawarta z chwilą skutecznego dokonania płatności. Do tego momentu miejsce jest rezerwowane dla nabywcy na czas ograniczony; w razie niedokonania płatności rezerwacja wygasa, a miejsce wraca do sprzedaży.

§ 6. Bilet i wstęp na teren Wydarzenia
6.1. Po dokonaniu płatności Uczestnik otrzymuje link do biletu elektronicznego. Link wyświetla się na stronie potwierdzenia bezpośrednio po płatności oraz jest wysyłany na podany adres poczty elektronicznej.
6.2. Bilet zawiera kod QR, który jest skanowany przy wejściu i wymieniany na opaskę.
6.3. Kod QR uprawnia do jednorazowego wstępu. Wstęp uzyskuje osoba, która okaże kod jako pierwsza.
6.4. Zrzut ekranu biletu jest równie skuteczny. Organizator nie ma możliwości odróżnienia oryginalnego biletu od jego kopii. Zabezpieczenie kodu przed udostępnieniem osobom trzecim należy do Uczestnika, który ponosi konsekwencje takiego udostępnienia.
6.5. Jeżeli Uczestnik nie może odnaleźć biletu, Organizator na jego wniosek ponownie wyśle link na adres poczty elektronicznej użyty przy zakupie.

§ 7. Przeniesienie wstępu na inną osobę
7.1. Wstęp może zostać przeniesiony na inną osobę wyłącznie za pośrednictwem Organizatora, poprzez ponowne wystawienie biletu na tę osobę.
7.2. Wniosek o przeniesienie, wskazujący imię, nazwisko i adres poczty elektronicznej osoby wstępującej w miejsce Uczestnika, składa się nie później niż 48 godzin przed pierwszym dniem Wydarzenia.
7.3. Przekazanie kodu QR nie stanowi przeniesienia. Ponowne wystawienie unieważnia poprzedni bilet; przekazanie kodu tego nie powoduje, a w razie okazania tego samego kodu przez dwie osoby wstęp uzyskuje wyłącznie pierwsza z nich.

§ 8. Odstąpienie, zmiany i odwołanie
8.1. Rezygnacja Uczestnika8.1.1. Bilety nie podlegają zwrotowi w razie rezygnacji Uczestnika z udziału.
8.1.2. Prawo odstąpienia od umowy zawartej na odległość nie przysługuje w odniesieniu do umów o świadczenie usług związanych z wypoczynkiem, wydarzeniami rozrywkowymi, sportowymi lub kulturalnymi, jeżeli w umowie oznaczono dzień lub okres świadczenia usługi — zgodnie z art. 38 pkt 12 ustawy z dnia 30 maja 2014 r. o prawach konsumenta. Bilet wskazuje Wydarzenie, miejsce i terminy, a zatem objęty jest tym wyłączeniem.
8.1.3. Zamiast odstąpienia Uczestnik może przenieść wstęp zgodnie z § 7.
8.2. Zmiany niestanowiące odwołania8.2.1. Żadna z poniższych okoliczności nie stanowi odwołania Wydarzenia i nie rodzi prawa do zwrotu:
a) zmiana składu instruktorów, w tym zastąpienie lub rezygnacja instruktora;
b) zmiana harmonogramu, kolejności punktów Wydarzenia lub godzin poszczególnych bloków;
c) zmiana sali lub piętra w obrębie miejsca Wydarzenia;
d) zmiana zakresu i terminów nagrań.
8.2.2. W przypadkach wskazanych w pkt 8.2.1 Wydarzenie, jego terminy i miejsce pozostają bez zmian, a bilet zachowuje ważność.
8.3. Przełożenie terminu8.3.1. Organizator nie zmienia terminów Wydarzenia ze względów organizacyjnej wygody. Przełożenie następuje wówczas, gdy okoliczności wskazane w pkt 8.5 uniemożliwiają przeprowadzenie Wydarzenia w ogłoszonych terminach.
8.3.2. W razie przełożenia bilet zachowuje ważność na nowe terminy i Uczestnik nie musi podejmować żadnych działań.
8.3.3. Jeżeli nowe terminy nie odpowiadają Uczestnikowi, może on wystąpić o zwrot w terminie 14 dni od ogłoszenia nowych terminów. Zwrot następuje na zasadach określonych w pkt 8.4.3.
8.4. Odwołanie Wydarzenia8.4.1. W razie odwołania Wydarzenia przez Organizatora zapłacona kwota podlega zwrotowi w całości, niezależnie od przyczyny odwołania.
8.4.2. Organizator może zaproponować w miejsce zwrotu rozwiązanie zastępcze, w szczególności wstęp na kolejną edycję Wydarzenia albo zaliczenie kwoty na poczet przyszłego wydarzenia. Propozycja taka stanowi ofertę i wywołuje skutek wyłącznie z chwilą jej przyjęcia przez Uczestnika. Uczestnik, który propozycji nie przyjmie, zachowuje prawo do zwrotu.
8.4.3. Zawiadomienie o odwołaniu wysyłane jest na adres poczty elektronicznej użyty przy zakupie, wraz z informacją o dalszym postępowaniu. Zwrot następuje na ten sam sposób płatności, którym dokonano zakupu, w rozsądnym terminie od wniosku Uczestnika, zwykle w ciągu 30 dni. W razie opóźnienia po stronie banku lub dostawcy usług płatniczych Organizator poinformuje o tym Uczestnika i będzie go informował aż do zaksięgowania środków.
8.4.4. Odpowiedzialność Organizatora ogranicza się do ceny biletu. Organizator nie zwraca kosztów transportu, zakwaterowania, urlopu ani innych wydatków poniesionych przez Uczestnika w związku z Wydarzeniem.
8.5. Okoliczności niezależne od stron8.5.1. Żadna ze stron nie narusza Regulaminu wskutek niewykonania zobowiązania spowodowanego okolicznościami pozostającymi poza jej rozsądną kontrolą, w szczególności: decyzjami, ograniczeniami lub zakazami organów władzy publicznej; epidemią lub stanem nadzwyczajnym; pożarem, powodzią lub inną klęską żywiołową; wojną, konfliktem zbrojnym, mobilizacją lub aktem terroru; strajkiem powszechnym; utratą możliwości korzystania z miejsca Wydarzenia; długotrwałą przerwą w dostawie energii elektrycznej, wody lub ciepła.
8.5.2. Jeżeli okoliczności takie uniemożliwiają przeprowadzenie Wydarzenia, Organizator przekłada je, o ile jest to możliwe, a wówczas stosuje się pkt 8.3. Jeżeli przełożenie nie jest możliwe, Organizator odwołuje Wydarzenie, a wówczas stosuje się pkt 8.4.
8.6. Sytuacje szczególne8.6.1. W przypadku ciężkiej choroby, śmierci osoby bliskiej albo omyłkowego zakupu Uczestnik może skontaktować się z Organizatorem, przedstawiając okoliczności. Takie sprawy rozpatrywane są indywidualnie i zależą od uznania Organizatora. Stanowi to działanie w dobrej woli i nie rodzi uprawnień wynikających z biletu.
8.7. Granice powyższych postanowień8.7.1. Żadne z postanowień § 8 nie ogranicza odpowiedzialności Organizatora za śmierć lub uszkodzenie ciała spowodowane przez Organizatora, za szkodę wyrządzoną umyślnie ani za inne przypadki, w których ograniczenie odpowiedzialności jest niedopuszczalne w świetle prawa polskiego. Bezwzględnie obowiązujące uprawnienia konsumentów przysługują niezależnie od postanowień Regulaminu.

§ 9. Uczestnictwo w Wydarzeniu
9.1. Uczestnictwo odbywa się na własne ryzyko Uczestnika. Uczestnik odpowiada za własny stan zdrowia i zdolność do udziału. Organizator zaleca posiadanie ważnego ubezpieczenia zdrowotnego i następstw nieszczęśliwych wypadków obejmującego terminy Wydarzenia.
9.2. Uczestnicy stosują się do poleceń obsługi Organizatora oraz do regulaminu obiektu.
9.3. Organizator może odmówić wstępu lub usunąć z terenu Wydarzenia osobę znajdującą się w stanie nietrzeźwości, zachowującą się agresywnie, stwarzającą zagrożenie dla innych albo uporczywie lekceważącą polecenia obsługi. Zwrot w takich przypadkach nie przysługuje.
9.4. Organizator nie odpowiada za rzeczy osobiste wniesione na teren Wydarzenia.

§ 10. Uczestnicy poniżej 18. roku życia
10.1. Zgodnie z prawem polskim osoba, która nie ukończyła 13 lat, nie ma zdolności do czynności prawnych, a czynność prawna dokonana przez taką osobę jest nieważna (art. 12 Kodeksu cywilnego). Jeżeli Uczestnik nie ukończył 13 lat, bilet nabywa rodzic lub opiekun prawny.
10.2. Osoba, która ukończyła 13 lat, a nie ukończyła 18 lat, ma ograniczoną zdolność do czynności prawnych. Czynność prawna, przez którą osoba taka zaciąga zobowiązanie, wymaga zgody jej przedstawiciela ustawowego (art. 17 Kodeksu cywilnego). Oświadczenie, o którym mowa w pkt 10.3, stanowi taką zgodę.
10.3. Uczestnik, który w dniu udziału nie ukończył 18 lat, okazuje pisemne oświadczenie rodzica lub opiekuna prawnego o zgodzie na jego udział w Wydarzeniu. Oświadczenie zawiera podpis, imię i nazwisko rodzica lub opiekuna oraz numer telefonu, pod którym będzie on dostępny w czasie trwania Wydarzenia.
10.4. Oświadczenie składa się przy wejściu wraz z biletem. Organizator przechowuje je przez czas trwania Wydarzenia oraz przez okres wskazany w Polityce prywatności.
10.5. W razie braku oświadczenia wstęp nie zostanie udzielony, a zwrot z tego tytułu nie przysługuje. Wzór oświadczenia udostępnia Organizator na żądanie.
10.6. Organizator nie sprawuje opieki nad osobami małoletnimi. Osoba małoletnia uczestniczy na zasadach obowiązujących pozostałych Uczestników, a odpowiedzialność za nią spoczywa przez cały czas na rodzicu lub opiekunie prawnym.

§ 11. Osoby towarzyszące
11.1. Osoba dorosła może przyprowadzić osobę małoletnią na miejsce Wydarzenia i tam oczekiwać, w strefie wskazanej przez obsługę Organizatora.
11.2. Osoby towarzyszące nie są wpuszczane na salę. Na sali przebywają wyłącznie osoby posiadające wstęp, na zasadach obowiązujących wszystkich Uczestników.

§ 12. Fotografowanie i nagrywanie
12.1. Wydarzenie jest fotografowane i nagrywane przez cały czas jego trwania. Materiały z zajęć, sali i miejsca Wydarzenia są publikowane w kanałach Organizatora i wykorzystywane w jego materiałach.
12.2. Jeżeli Uczestnik występuje jako jedna z wielu osób — podczas zajęć, w grupie lub w ujęciu ogólnym sali — materiał taki publikowany jest bez odrębnego zezwolenia. Zgodnie z art. 81 ust. 2 pkt 2 ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych zezwolenia nie wymaga rozpowszechnianie wizerunku osoby stanowiącej jedynie szczegół całości takiej jak zgromadzenie lub impreza publiczna.
12.3. Jeżeli Organizator zamierza uczynić rozpoznawalnego Uczestnika przedmiotem materiału reklamowego, uzyskuje uprzednio zgodę tej osoby.
12.4. Uczestnik, który nie życzy sobie występowania w nagraniach, informuje o tym Organizatora przed Wydarzeniem lub w jego trakcie, a Organizator wyłącza tę osobę z materiałów pozostających pod jego kontrolą.
12.5. Nagrywanie przez Uczestników dozwolone jest wyłącznie do celów prywatnych, niekomercyjnych.

§ 13. Muzyka i własność intelektualna
13.1. Odpowiedzialność za muzykę przyniesioną i odtwarzaną przez Uczestnika, w tym rozliczenie praw do niej, spoczywa na tym Uczestniku. Roszczenia podmiotów uprawnionych wynikające z takiej muzyki rozlicza Uczestnik, bez udziału Organizatora.
13.2. Materiały publikowane przez Organizatora, w tym strona internetowa, fotografie, nagrania, identyfikacja wizualna Wydarzenia i materiały marketingowe, stanowią własność Organizatora lub jego licencjodawców. Ich ponowna publikacja, odsprzedaż, udzielanie sublicencji lub rozpowszechnianie są zabronione.

§ 14. Dane osobowe
14.1. Przetwarzanie danych osobowych reguluje Polityka prywatności, stanowiąca integralną część Regulaminu.

§ 15. Reklamacje i prawo właściwe
15.1. Reklamacje składa się na adres kontaktowy wskazany w pkt 1.2. Organizator udziela odpowiedzi w terminie 14 dni od otrzymania.
15.2. Regulamin podlega prawu polskiemu. Spory rozpoznaje sąd właściwy dla siedziby Organizatora. Postanowienie to nie ogranicza uprawnień konsumentów wynikających z bezwzględnie obowiązujących przepisów prawa polskiego lub prawa Unii Europejskiej.

§ 16. Zmiany Regulaminu
16.1. Organizator może zmienić Regulamin. Do danego zakupu stosuje się wersję obowiązującą w chwili jego dokonania, której kopię przechowuje Organizator. Zmiany nie działają wstecz w stosunku do biletów już sprzedanych.

Dark Dance Camp Winter 2027
1. The Organiser
1.1. The event is organised and tickets are sold by Magnitudo Group sp. z o.o., with its registered office at ul. Wyspa Słodowa 7 lok. 220, 50-266 Wrocław, Poland, entered in the National Court Register under KRS number 0001067988, NIP PL8971929665, REGON 526938578 (hereinafter: the Organiser).
1.2. Contact address for all matters concerning tickets, participation and personal data: office@darkdancestudio.com.
1.3. These Terms and Conditions govern the sale of admission to the event and the rules of participation in it. By purchasing a ticket, the Participant accepts these Terms and Conditions.

2. The event and the subject of sale
2.1. Dark Dance Camp Winter 2027 (hereinafter: the Event) is a cultural and entertainment event held on 19–21 February 2027 at Grabiszyńska 241d, 53-235 Wrocław, Poland.
2.2. The subject of sale is the right of admission to the Event at the place and on the dates specified in clause 2.1. The subject of sale is not a course of instruction, a series of lessons, a subscription, or access provided online or otherwise remotely.
2.3. The Event runs on site over three days and consists of:
a) classes led by invited instructors, in accordance with the published schedule;
b) filmed sessions, including selects, during which instructors dance with selected participants or a participant performs individually, recorded by a camera operator;
c) other activities announced in the schedule, including parties, jams and gatherings connected with the Event.
2.4. Everything set out in clause 2.3 takes place in person, at the venue, at the times published in the schedule. The Organiser does not provide streaming, remote participation, recordings for later use, or any materials to be taken away.
2.5. Admission entitles the Participant to be present at the Event while it is taking place. It does not entitle the Participant to any recording of a class, to a copy of any footage, or to any other material.
2.6. Admission does not include transport, accommodation, meals, insurance or equipment.

3. Types of admission
3.1. Three types of admission are sold. Each constitutes admission to the Event at the venue and on the dates specified in clause 2.1, differing only in how much of the Event it covers:

3.2. Each type of admission is sold in a limited number. Once the limit is reached, sale of that type ceases.
3.3. The schedule is finalised before the Event and may be amended during it. Its composition, order and timing are determined by the Organiser.

4. Price, tax and invoices
4.1. All prices stated are gross prices and include Polish value added tax. The rate applied and the net amount are itemised on the invoice.
4.2. Services consisting in admission to cultural and entertainment events are taxed at the place where the event is actually held. Accordingly, Polish VAT applies to every ticket irrespective of the Participant's place of residence or the place from which payment is made. The above follows from art. 28g(1) of the Act of 11 March 2004 on Value Added Tax and art. 53 of Council Directive 2006/112/EC.
4.3. The rule set out in clause 4.2 applies equally to purchases made by businesses. The reverse charge mechanism does not apply to admission services. The Organiser charges Polish VAT and accounts for it, including where the purchaser holds a VAT identification number issued in another Member State of the European Union.
4.4. A purchaser wishing to receive an invoice issued to a business shall provide that business's EU VAT identification number during the purchase process. The Organiser verifies the number in the VIES system at the time of sale and retains a dated record of that verification.
4.5. Each purchase results in the issue of an invoice by the Organiser, stating the Event, the venue and the dates. The invoice is sent to the email address provided during the purchase process.

5. Purchase
5.1. Tickets are sold exclusively online, through the Event's ticket page.
5.2. Payments are processed by Stripe Payments Europe, Ltd. The Organiser does not receive, process or store payment card data.
5.3. The contract is concluded upon successful completion of payment. Until that time a place is reserved for the purchaser for a limited period; if payment is not completed, the reservation lapses and the place is released.

6. The ticket and admission to the venue
6.1. Following payment, the Participant receives a link to an electronic ticket. The link is displayed on the confirmation page immediately after payment and is sent to the email address provided.
6.2. The ticket bears a QR code, which is scanned at the entrance and exchanged for a wristband.
6.3. The QR code is valid for a single admission. Admission is granted to the person who presents the code first.
6.4. A screenshot of the ticket is equally valid. The Organiser is unable to distinguish between the original ticket and a copy of it. Safeguarding the code against disclosure to third parties is the responsibility of the Participant, who bears the consequences of such disclosure.
6.5. Where the Participant is unable to locate the ticket, the Organiser shall resend the link to the email address used for the purchase, upon request.

7. Transfer of admission
7.1. Admission may be transferred to another person exclusively through the Organiser, by means of reissuing the ticket in that person's name.
7.2. A request for transfer, stating the name and email address of the person taking the Participant's place, shall be submitted no later than 48 hours before the first day of the Event.
7.3. Forwarding the QR code does not constitute a transfer. Reissue invalidates the previous ticket; forwarding does not, and where two persons present the same code, admission is granted only to the first.

8. Withdrawal, changes and cancellation
8.1. Withdrawal by the Participant
8.1.1. Tickets are not refundable where the Participant decides not to attend.
8.1.2. The right to withdraw from a contract concluded at a distance does not apply to contracts for services related to leisure activities, entertainment events, sporting events or cultural events, where the contract specifies the day or period of performance, pursuant to art. 38(12) of the Act of 30 May 2014 on Consumer Rights. The ticket specifies the Event, the venue and the dates, and accordingly falls within that exclusion.
8.1.3. In place of withdrawal, the Participant may transfer admission in accordance with clause 7.
8.2. Changes that do not constitute cancellation8.2.1. None of the following constitutes cancellation of the Event and none gives rise to a right of refund:
a) a change to the instructor line-up, including replacement or withdrawal of an instructor;
b) a change to the schedule, to the order of the Event or to the timing of individual blocks;
c) a change of room or floor within the venue;
d) a change to what is filmed and when.
8.2.2. In the cases set out in clause 8.2.1, the Event, its dates and its venue remain unchanged and the ticket remains valid.
8.3. Postponement8.3.1. The Organiser does not alter the dates of the Event for reasons of convenience. Postponement occurs where circumstances specified in clause 8.5 prevent the Event from being held on the dates announced.
8.3.2. In the event of postponement, the ticket remains valid for the new dates and no action is required of the Participant.
8.3.3. Where the new dates are not suitable, the Participant may request a refund within 14 days of the announcement of the new dates. The amount paid is refunded in accordance with clause 8.4.3.
8.4. Cancellation8.4.1. Where the Organiser cancels the Event, the amount paid is refunded in full, irrespective of the reason for cancellation.
8.4.2. The Organiser may propose an alternative in place of a refund, in particular admission to a subsequent edition of the Event or a credit towards a future event. Such a proposal constitutes an offer and takes effect solely upon its acceptance by the Participant. A Participant who does not accept the proposal retains the right to a refund.
8.4.3. Notice of cancellation is sent to the email address used for the purchase, together with instructions on how to proceed. Refunds are made to the payment method used for the purchase, within a reasonable period following the Participant's request, ordinarily within 30 days. Where a delay arises on the part of a bank or payment provider, the Organiser shall inform the Participant and keep the Participant informed until the funds are credited.
8.4.4. The Organiser's liability is limited to the price of the ticket. The Organiser does not reimburse the costs of transport, accommodation, time taken off work, or any other arrangements made by the Participant in connection with the Event.
8.5. Circumstances beyond control8.5.1. Neither party is in breach of these Terms and Conditions on account of a failure to perform caused by circumstances beyond its reasonable control, including in particular: decisions, restrictions or prohibitions imposed by public authorities; an epidemic or a state of emergency; fire, flood or other natural disaster; war, armed conflict, mobilisation or an act of terrorism; a general strike; the venue becoming unusable; or a prolonged failure of the supply of electricity, water or heating.
8.5.2. Where such circumstances prevent the Event from being held, the Organiser shall postpone it where this is possible, and clause 8.3 shall apply. Where postponement is not possible, the Organiser shall cancel the Event, and clause 8.4 shall apply.
8.6. Exceptional circumstances8.6.1. In cases of serious illness, the death of a close family member, or a purchase made in error, the Participant may contact the Organiser with a description of the circumstances. Such cases are considered individually and at the discretion of the Organiser. This constitutes a goodwill measure and does not confer any entitlement arising from the ticket.
8.7. Limits on the foregoing8.7.1. Nothing in this clause 8 limits the Organiser's liability for death or personal injury caused by the Organiser, for intentional harm, or for any other matter which may not be limited under Polish law. The mandatory rights of consumers apply irrespective of the provisions of these Terms and Conditions.

9. Participation in the Event
9.1. Participation takes place at the Participant's own risk. The Participant is responsible for their own physical condition and fitness to take part. The Organiser recommends that Participants hold valid health and accident insurance covering the dates of the Event.
9.2. Participants shall comply with the instructions of the Organiser's staff and with the rules of the venue.
9.3. The Organiser may refuse admission to, or remove from the venue, any person who is intoxicated, behaves aggressively, endangers others, or persistently disregards the instructions of staff. No refund is due in such cases.
9.4. The Organiser is not liable for personal belongings brought to the venue.

10. Participants under 18 years of age
10.1. Under Polish law, a person who has not attained the age of 13 does not have capacity to perform legal acts, and a legal act performed by such a person is void (art. 12 of the Civil Code). Where the Participant is under 13 years of age, the ticket shall be purchased by a parent or legal guardian.
10.2. A person aged between 13 and 17 years has limited capacity to perform legal acts. A legal act by which such a person incurs an obligation requires the consent of their statutory representative (art. 17 of the Civil Code). The statement referred to in clause 10.3 constitutes such consent.
10.3. A Participant who is under 18 years of age on the day of attendance shall present a written statement of a parent or legal guardian consenting to their participation in the Event. The statement shall be signed and shall state the name of the parent or guardian and a telephone number at which they may be contacted during the Event.
10.4. The statement shall be submitted at the entrance together with the ticket. The Organiser retains it for the duration of the Event and for the period specified in the Privacy Policy.
10.5. In the absence of the statement, admission shall be refused, and no refund is due on that ground. A template of the statement is available from the Organiser upon request.
10.6. The Organiser does not provide supervision or care of minors. A minor participates on the same terms as other Participants, and responsibility for the minor rests at all times with the parent or legal guardian.

11. Accompanying persons
11.1. An adult may bring a minor to the venue and wait there, in the area indicated by the Organiser's staff.
11.2. Accompanying persons are not admitted to the hall. Only holders of admission are present in the hall, on the terms applicable to all Participants.

12. Photography and filming
12.1. The Event is photographed and filmed throughout. Recordings of the classes, the hall and the venue are published in the Organiser's channels and used in the Organiser's materials.
12.2. Where the Participant appears as one of a number of persons — during a class, within a group or in a general view of the venue — such material is published without separate permission. Pursuant to art. 81(2)(2) of the Act of 4 February 1994 on Copyright and Related Rights, permission is not required for the dissemination of the image of a person constituting only a detail of a whole such as a public event.
12.3. Where the Organiser intends to make an identifiable Participant the subject of advertising material, the Organiser shall obtain that person's consent beforehand.
12.4. A Participant who does not wish to appear in recordings shall notify the Organiser before or during the Event, and the Organiser shall exclude that person from material under its control.
12.5. Recording by Participants is permitted for personal, non-commercial purposes only.

13. Music and intellectual property
13.1. Responsibility for music brought and played by a Participant, including the settlement of rights to it, rests with that Participant. Claims of rightholders arising from such music are settled by the Participant, without the involvement of the Organiser.
13.2. Materials published by the Organiser, including the website, photographs, recordings, the Event's visual identity and marketing materials, are the property of the Organiser or its licensors. Their republication, resale, sublicensing or distribution is prohibited.

14. Personal data
14.1. The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms and Conditions.

15. Complaints and applicable law
15.1. Complaints shall be submitted to the contact address specified in clause 1.2. The Organiser shall respond within 14 days of receipt.
15.2. These Terms and Conditions are governed by Polish law. Disputes are subject to the jurisdiction of the court having jurisdiction over the Organiser's registered office. This provision does not limit the rights of consumers arising from mandatory provisions of Polish or European Union law.

16. Amendments
16.1. The Organiser may amend these Terms and Conditions. The version applicable to a given purchase is the version in force at the time that purchase was made, a copy of which is retained by the Organiser. Amendments do not apply retroactively to tickets already sold.
